1. About 101 Pandit

101 Pandit is an AI-powered digital wellness and entertainment application that provides astrology readings, numerology analysis, palmistry interpretations, vastu tips, gemstone suggestions, ritual recommendations, and related spiritual content (collectively, "Readings"). Content is generated using artificial intelligence, including large language models (LLMs), combined with traditional astrological, numerological, and spiritual frameworks.

2. Nature of Content — Entertainment and Spiritual Exploration Only

IMPORTANT: All content provided by 101 Pandit is for entertainment and personal spiritual exploration purposes only.

All Readings, predictions, reports, remedies, gemstone suggestions, vastu tips, ritual recommendations, and AI-generated responses are:

• Provided for entertainment, personal reflection, and spiritual exploration only
• Not medical, clinical, psychological, therapeutic, psychiatric, or mental health advice
• Not legal, financial, tax, investment, accounting, or professional advisory services
• Not emergency services of any kind
• Not guaranteed to be accurate, complete, reliable, or suitable for any purpose

You should always consult a qualified, licensed professional (such as a doctor, mental health professional, lawyer, or financial adviser) before making any important personal, health, financial, legal, or other life decisions.

We make no representations, warranties, or guarantees regarding the accuracy, validity, or predictive accuracy of any content generated by the App.

3. Eligibility and Age Requirements

By using the App, you represent and warrant that:

• You are at least 13 years of age (or the minimum digital age of consent in your jurisdiction, whichever is higher);
• If you are between 13 and 18 years of age (or the applicable age of majority in your jurisdiction), you have obtained verifiable consent from a parent or legal guardian before using the App and sharing any personal data;
• You have the legal capacity to enter into a binding agreement with us;
• Your use of the App complies with all laws and regulations applicable in your jurisdiction.

If you are a parent or legal guardian allowing a minor to use the App, you accept these Terms on their behalf and take full responsibility for their use of the App.

We reserve the right to terminate access for any user who does not meet these eligibility requirements.

4. Your Account

To access certain features, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information when creating or updating your account
• Maintain the confidentiality of your account credentials and not share them with others

• Accept responsibility for all activity that occurs under your account

We reserve the right to refuse registration, suspend, or terminate accounts at our discretion, including if we suspect a violation of these Terms.

5. Acceptable Use and Prohibited Conduct

You agree to use the App lawfully and in good faith. You must not:

• Misuse content: Copy, reproduce, distribute, publicly display, or create derivative works from any part of the App or its generated content without our prior written permission.
• Attempt to circumvent: Reverse-engineer, decompile, disassemble, scrape, crawl, mirror, or otherwise attempt to extract source code or underlying data from the App.
• Interfere with systems: Disrupt, overload, or impair the App or its infrastructure, or attempt to gain unauthorised access to our systems or data.
• Submit harmful content: Upload, transmit, or input content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Misrepresent identity: Impersonate any person or entity, or falsely claim an affiliation with any organisation.
• Commit fraud: Use the App for any fraudulent, deceptive, or misleading purpose.
• Abuse AI features: Attempt to manipulate, jailbreak, circumvent content filters of, or extract training data from AI systems used in the App.
• Commercial exploitation: Use the App or its outputs for commercial, resale, or revenue-generating purposes without our explicit written consent.
• Facilitate harm: Use the App in any way that could harm, endanger, or harass other users or third parties.

We reserve the right to monitor use of the App to enforce these Terms and to take appropriate action, including account suspension or termination.

6. Data You Provide — Accuracy and Responsibility

The accuracy and quality of Readings generated by the App depend on the information you provide. You are solely responsible for the accuracy, completeness, and truthfulness of all data you input, including birth details and uploaded images.

By uploading palm images or other content, you represent and warrant that:

• You are the owner of, or have the necessary rights to share, the content you upload
• The content does not infringe any third-party intellectual property, privacy, or other rights
• The content does not contain unlawful, harmful, or inappropriate material

You grant us a limited, non-exclusive, non-transferable licence to process content you upload solely to provide the App's features to you, as described in our Privacy Policy.

7. Payments, Purchases, and Refunds

Certain features of the App require a one-time payment or time-bound purchase to access.

Before completing any purchase:

• The duration, included features, and price will be clearly displayed
• You will have the opportunity to review your purchase before confirming

Payment methods:

• App Store (Apple): Governed by Apple's payment terms and policies
• Google Play Store: Governed by Google's payment terms and policies
• Razorpay: For applicable in-app transactions in India and other supported markets

Unless expressly stated otherwise at checkout:

• Purchases do not auto-renew and you will not be charged again automatically at the end of the access period
• All purchases are final and non-refundable, except where required by applicable law or the policies of the relevant payment provider or platform

For App Store and Google Play purchases, refund requests must be made directly to Apple or Google respectively, in accordance with their policies. For Razorpay purchases, contact us at 101panditapp@gmail.com.

We reserve the right to change pricing at any time. Changes will not affect purchases already completed.

8. Intellectual Property

All intellectual property rights in the App, including but not limited to the software, design, user interface, branding, logos, text, AI systems, reports, and all related materials, are owned by us or our licensors and are protected under applicable intellectual property laws, including the Copyright Act, 1957 (India) and equivalent international laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the App strictly for your own personal, non-commercial purposes, in accordance with these Terms.

This licence does not permit you to:

• Sub-license, sell, resell, transfer, or assign the App or any rights to it
• Modify, adapt, translate, or create derivative works based on the App
• Use the App or any generated content for commercial purposes
• Remove or obscure any proprietary notices or labels on the App

Any AI-generated content provided to you through the App is licensed, not sold, to you for personal use only. We do not warrant that such content is original or free from third-party rights.

9. Third-Party Services and Links

The App may integrate with or link to third-party services, including Firebase, payment providers, and AI processing providers. These third parties have their own terms of service and privacy policies, which you may be subject to when using their services through our App.

We are not responsible for the content, practices, or policies of third-party services. We encourage you to review their respective terms and privacy policies.

10. Disclaimer of Warranties

101 Pandit is provided on an "AS IS" and "AS AVAILABLE" basis, without any express or implied warranties of any kind. To the fullest extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be available, uninterrupted, secure, error-free, or free of viruses or harmful components
• Warranties regarding the accuracy, completeness, reliability, timeliness, or suitability of any content generated by the App
• Warranties regarding the results you may obtain from using the App

Nothing in these Terms affects statutory rights you may have that cannot be excluded under applicable consumer protection law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Pieco Labs LLP, its directors, employees, partners, agents, suppliers, and licensors shall not be liable for:

• Any indirect, incidental, consequential, special, exemplary, or punitive damages
• Loss of profits, revenues, data, goodwill, or business opportunities
• Damages arising from your reliance on any content or Readings provided by the App
• Damages arising from decisions or actions taken on the basis of App content
• Unauthorised access to or alteration of your data by third parties

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the greater of: (a) the total amount you paid to us in the 12 months preceding the claim; or (b) INR 1,000 (or equivalent in your local currency).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, or wilful misconduct, or any liability that cannot be excluded under applicable consumer protection law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Pieco Labs LLP and its directors, officers, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of or access to the App
• Your violation of these Terms
• Your violation of any applicable law or the rights of any third party
• Any content you submit, upload, or transmit through the App

13. Account Deletion and Termination

You may delete your account at any time from the Profile or Settings section of the App. Upon account deletion, we will process removal of your personal data within 30 days, subject to any data we are required to retain for legal, compliance, fraud-prevention, accounting, dispute-resolution, or security purposes.

We may suspend, restrict, or terminate your access to the App, without notice or liability, if:

• You breach these Terms or our Privacy Policy
• You engage in abusive, harmful, or fraudulent conduct
• You attempt unauthorised access to our systems or AI infrastructure
• We are required to do so by law or court order
• We discontinue the App (in which case we will provide reasonable prior notice where possible)

Upon termination, your licence to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination (including intellectual property rights, disclaimers, limitations of liability, and governing law) will remain in effect.

14. Mental Health, Wellbeing, and Emergency Services

If you are experiencing a mental health crisis, emotional distress, or a medical emergency, please contact your local emergency services or a qualified mental health professional immediately.

The App is not a crisis service and does not provide mental health support, counselling, or emergency response. Readings provided by the App should never be used as a substitute for professional mental health care.

15. Accessibility and Inclusive Use

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Provide notice through an in-App notification or other appropriate channel
• Update the "Last Updated" date at the top of this document
• Where required by applicable law, seek your renewed consent before the changes take effect

Your continued use of the App after updated Terms become effective constitutes your acceptance of the updated Terms. If you do not agree with any changes, you must stop using the App and may delete your account.

17. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

For users in India: Subject to applicable law, any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

For users outside India: Where local mandatory law in your jurisdiction applies greater consumer protections or grants jurisdiction to a local court, those protections are not waived by these Terms.

18. General Provisions

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Pieco Labs LLP with respect to the App and supersede all prior agreements.
• Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary or severed, and the remaining provisions shall continue in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely.
• No Third-Party Beneficiaries: These Terms do not confer any rights or remedies on any third party.
• Force Majeure: We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, civil unrest, or government restrictions.
